You can be charged with criminal negligence if there is sufficient evidence that you should have been aware of a “substantial and unjustifiable risk” that the circumstances surrounding your conduct existed or the death would likely occur. Punishment for this criminal offense may include imprisonment in a state jail for 180 days (i.e. 6 months), but not longer than two years.
